Alternative Dispute Resolution (“ADR”) has long been seen as the only method to solve the docket problem prevalent in Indian Courts. Mediation is one such ADR method which is becoming more popular amongst the legal fraternity as it resolves disputes outside courtrooms and avoids the unnecessary procedural delays inherent in the Indian justice system. Hence, it is imperative that law students also understand the intricacies of Mediation and it was to this end that the present Classroom Series Program on mediation under the aegis of E-Mediation Writings was formed.
The first webinar in this series was held on December 5, 2020 on the topic “Importance of Mediation-DOOR TO DOOR (Door of Opportunities to Resolve- Door of Opportunities to Reform) wherein Mr. Colin Rule, the President and CEO of mediate.com and Mr. Shiv Kumar, Advocate with 40 years of active practice at the Karnataka High Court shared their views on the topic with the law students.
Mr. Shiv Kumar emphasized on the recommendations of the NITI Aayog on the use of ODR in India.
Continuing the series, in a webinar on “Mediation Education” was organized by EMW, on 1st January 2021, wherein Shri Manan Kumar Mishra, Senior Advocate and Chairman, Bar Council of India conveyed his best wishes to the Pan-India Mediator Coordinators of E-Mediation Writings (EMW), (India’s 1st e-magazine dedicated to mediation, launched online on 1st June 2020 with the blessings from and by Hon’ble Health Minister of India, Dr. Harsh Vardhan, for its another unique pro-bono initiative, first of its kind in India) for initiating India’s First EMW Online Classroom Series 2021 for the Law Students from 21 States/UTs of our country from 2nd January 2021. The idea behind this is to impart knowledge on Mediation, based on the recent proposed curriculum by apex regulatory body, Bar Council of India. It is an initiation of Pan–India Coordinators of Team E-Mediation Writings, which is a unique amalgamation of cultural diversity and rich heritage of our nation. In the first class of the series 77 students participated in a lecture by Mr. A.J. Jawad, Senior International Mediator and a Trainer, who shed light on the nature and root cause of conflicts in an enriching talk on the importance of mediation.
Future Classes will also have legendary mediator speakers from our country, imparting education on mediation to our country’s generation next envoys of peaceful resolution mechanism in justice delivery system of our India. The entire series is supervised by Ms. Pusshp Gupta, Advocate/Mediation Trainer and Coordinator-in-Chief, E-Mediation Writings (EMW) and Mr. Thankachan V.P. Advocate/Mediation Trainer and Senior Member, EMW.
