Registration is a proof of ownership, and it is also an important document for the sale of a vehicle and transfer of its ownership. Vehicle Registration is mandatory under the purview of Section 39 of The Motor Vehicle Act, 1988 which falls under the Concurrent List of Schedule VII of the Constitution of India. Section 39 prohibits driving of any unregistered motor vehicle and states that no owner of the vehicle should permit driving of an unregistered vehicle in a public place which is not registered under the provision of the MV Act. The exception to this provision is cars with the dealers. Section 192 of The Motor Vehicle Act, 1988, states that whoever, drives a motor vehicle or causes or allows a motor vehicle to be used in contravention of the provisions of Section 39 shall be punishable, with a fine which may extend to five thousand rupees but shall not be less than two thousand rupees. Subsequent offences shall be an imprisonment which may extend to one year or with fine which may extend to ten thousand rupees but shall not be less than five thousand rupees or with both. The implementation of various provisions of this Act rests with the State Governments.
Whom to approach for registration of a motor vehicle?
For registration, you have to approach the local zonal office of the Transport Department for registration of private/non-commercial vehicles.
Procedure for registration of new private/non-commercial vehicle
During the registration process, the vehicle is properly inspected physically at the zonal office for its particulars followed by its registration. The documents which are required for registration are:
- A fully filled up Form 20.
- Form 21 (Sale Certificate ) and Form 22 (Road worthiness certificate) issued by the vehicle dealer and the manufacturer respectively.
- An attested copy of a valid vehicle insurance policy/cover note, address A duly signed Form 34 by owner and the financier.
- Payment of a one-time road tax, M.C.D parking fees and prescribed fee for registration
- The PAN Card or Form 60 & 61 (as applicable) along with dealer invoice and manufacturer invoice.
Procedure for registration of new commercial vehicle
All commercial / transport vehicles are registered with the transport department, where the application should be accompanied with the following requirements:.
- Letter of Intent issued from State Transport Authorities Branch.
- Manufacturing Invoice.
- Form no. 20, Form no.21 and Form no. 22.
- Certificate of fitness issued by the board of inspectors from inspection pit Burari.
- Attested copy of the address proof, insurance certificate/cover note.
- Form no. 34 (in case the vehicle is purchased on loan)
- Road tax and prescribed fee for registration.
- Attested copy of PAN card or Form 60 & 61 (as applicable).
- A vehicle like TSR & Taxi is registered at inspection pit Burari.
In the case of a change of Address in the Registration Certificate the following documents are mandatory:
- A fully filled up Form No. 33.
- Original Registration Certificate of vehicle.
- Attested copy of valid insurance, address proof of the registered owner, valid pollution under control certificate and copy of PAN Card or Form 60 & 61(as applicable)
- Payment of a prescribed fee of Rs. 50 & Rs. 370 for the smart card.
- No Objection Certificate from the financier is necessary in case of change of address in Registration Certificate.
The change of address should be applied within 14 days from the date of effect, after that penalty of Rs. 100 per month is applicable.
Assignment of new registration marks or renewal to another state
If a registered owner of a vehicle brings the vehicle to Delhi, which has already been registered in another state of India after obtaining an N.O.C from the concerned state can apply for re-registration in Delhi, the documents required for this are as follows:
- Original registration certificate of another state.
- Form 28 (NOC in duplicate), Form 27 &Form 20.
- An Attested copy of address proof, valid insurance, and pollution under control certificate.
- In the case of the commercial vehicle, Challan clearance from traffic police or enforcement wing of transport department is important.
- Fitness certificate issued by the board of inspection Burari.
- Road tax, parking fees and Registration fee (as applicable).
- PAN Card or Form 60 & 61(as applicable).
- A Certificate regarding emission norms.
Procedure of re-registration of motor vehicles brought to Delhi from other states
If a registered owner of a vehicle brings the vehicle to Delhi, which has already been registered in some other state of India after obtaining an N.O.C from the concerned state, he can apply for re-registration in Delhi, The documents required for this are as follows:
- Other state registrations certificate in original.
- Form 28 (NOC in duplicate)
- Form 27 and Form 20.
- Attested copy of address proof, valid insurance and pollution under control certificate.
- In the case of the commercial vehicle, challan clearance from traffic police or enforcement wing of transport department.
- Fitness certificate issued by the board of spec. Burari.
- Road tax, parking fees and registration free.
- PAN Card or Form 60 & 61 (as applicable).
- Certificate manufactured regarding emission norms.
Re-Registration of private vehicle
After completion of 15 years, every registered owner is required to get the vehicle re-registered from the same transport office.
Procedure for issue of duplicate registration certificate
Any registered owner can apply for a duplicate registration certificate in case the original one is either lost or mutilated after submitting following documents:
- Application on form 26 (in duplicate and one copy duly attested along with the endorsement from the financier of Hypothecated).
- Original copy of the F.I.R/N.C.R.
- Attested copy of valid insurance policy.
- Attested copy of pollution under control certificate.
- Attested copy of address proof.
- Prescribed fee.
- Challan clearance from traffic police & Enforcement wing Transport Department in commercial vehicles.
- Tax clearance from Accounts Department in commercial vehicles.
- Attested copy of PAN Card or Form 60 & 61(as applicable)
Procedure for temporary registration
As per the provision of section 43 of the central motor vehicle Act, temporary registration certificate can be given to a vehicle only in a case when the owner of a vehicle wants to take the vehicle to another state. The maximum period of validity of temporary registration made under this section is one month, and it is not renewable.
The temporary registration is also known as a transit registration because the destination point is also mentioned in it where the vehicle has to reach. This registration can be done at M.L.O. (HQ). The Transport Department can also delegate this registration power to the vehicle manufacturers or other concerned zonal offices.
