Introduction

Labour law refers to the laws regulating employment. In India, there over 50 national laws and many more at the state level. As per Article 246(4) of the Constitution of India, both the Centre and the State can make laws on labour laws. Mostly the Parliament enact the laws relating to labour laws and the State government implement those laws through their administrative authority. Certain laws such as the Minimum Wages Act are applicable to establishments employing a single person. The constitutional status of labour jurisdiction has been explained in the following table.

Labour department ensures effective enforcement of various labour laws by which it facilities harmonious industrial relations. It protects and safeguards the interest of workers and it acts as an instrument for conciliation and conflict resolution between the labour and the management.

Functions of the Labour Department

  • To implement State labour laws and employment laws for ensuring basic statutory working conditions and labour standards.
  • To protect the interests of workers, both in organized and unorganized sectors and to maintain industrial peace and harmony.
  • To Ensure wages, safety, welfare, working hours, weekly & other holidays, leave etc. for workers.
  • To eliminate employment of all forms of child labour and rehabilitation of those released from work
  • To promote the welfare and social security of workers by the implementation of schemes.
  • To provide social security to the injured workmen and maternity benefit to the women workers
  • To provide for registration and Licensing of Establishments and collection of labour welfare fund.
  • To provide for registration of trade union and unorganized sector.

  • Registration/Grant of Licence/Renewal/Amendment of the factory license under Factories  Act, 1948.
  • Registration/Amendment of Establishment of Employing contract workers under contract labour (R&A) Act, 1970.
  • Grant of Licence/Renewal/Amendment of contract labour license under the contract labour act (R&A) Act, 1970.
  • Registration/Amendment of Establishments employing migrant workmen under Inter State migrant workmen Act, 1979.
  • Grant of Licence/Renewal/Amendment of Establishments employing migrant workmen under Inter State migrant workmen Act, 1979.
