❏      Now, if the council finds the crime done by the doctor or hospital is serious and led to the danger of the life of the patient then, the council can initiate action against the doctor by suspending his license for a relevant period of time, until the matter is finished.

❏      And after this, if the doctor or the hospital is proved guilty then, he can get imprisonment which will be decided on the basis of the seriousness of the negligence done on their part.

❏      If the patient is not satisfied with the decision of the council, he or she can again appeal to the Medical council of India.

❏      The complainant- if seeking for monetary compensation- can seek the help from consumer courts (it should be kept in mind that the consumer courts can only give remedy as compensation and it does not have the right to punish the doctor or the hospital).

❏       Now, if the complainant is not happy or satisfied with the decision of the consumer court, he can again appeal to the National consumer dispute redressal forum. They can also go to the Supreme Court further.

Please take note of this doctor Jaswal who i have full doubt that he is doing unauthorised trial in India for his son who is doing reasearch in US and putting life of innocent patients in India at stake. He has not only deleted Sufferer patients guardians comments in his above stated blog but also deleted earleir all negative comments and also restricted the posting of comments by members only. It means once a patient died his guardians are no more member of this site hence can not even give comments. Which is wrong and unethica and clear message that he is playing with the life of peoples here in INDIA for which he has sepcialy came from US recently. Please take note of this and please check his medicines which he prepares from the chemicals he buys from chandani chowk generally. He is looting lacs of rupees from innocent peoples in the name of herbal medicines but actually very dangerous chemicals. I have few of those medicines which he used to give us..

    I have visited to dentist Yash Saxena for toothache issue at his clinic Re smile in pipeline in Asalpha. But in the clinic his wife Dr. Leher was available who checked me and suggested route canal treatment and charges was rs. 3000/-. After 2 days I went for root canal treatment on 23rd Dec evening where Dr. Leher has given me local Anaesthesia. But when she was about to start the treatment she came to know her machine is not working so she sent me alone to another clinic in Asalpha Metro station where Dr. Yash Saxena was available and waiting for me to start my RCT treatment. Dr. Yash had guven me more local anaesthesia again and drilled my tooth and immediately filled it with some white paste. After that he took my tooth xray and said your root of this tooth needs to be removed otherwise there will be infection later on. So he was trying rigourously for almost 1 hours time to remove my half teeth with root. And send me back suggesting paracetamol as pain killer and some antibiotic and acidity tablet. And he took 2000 rs and asked to come back after 1 week.
    But after ending of anaesthesia effect my tooth extracted area started paining. My cheek also got swelling. This swelling have not gone for next 3 days so my husband suggested me to take opinion of another dentist Dr.Dalbir Singh in navi mumbai near our home.
    Dr. Dalbir said this tooth ectraction is not normal, its traumatic tooth extraction and he took xray again and found out that root of extacted half teeth is still in there and now need to do surgery to remove it.
    After 2 days we visited Hiranandani hospital Vashi to be sure about requirment of surgery where Dr. Arvind alsi suggested same surgery and bone grafting treatment due to dry socket condition. Dr. Yash tried to do hemisection but this is not the way of doing hemisection procedure. A trainee can do better job than Dr. Yash Saxena.
    Now I have to go through surgery wherein I will get stiches and artificial bone. Fir this treatment i will have to pay inr 15000/-
    We asked Dr. Saxena to pay off my bills but he is refusing and also saying I will do this treatment in my clinic but I dont trust this doctor now.
    I want to highlight this issue and medival negligence of Dr. Yash Saxena and his wife Dr. Leher Srivastava. Because of them I suffered a lot of pain and my money also wasted. Also they do not mention their registration no. on their prescription paper.
    Pls take strict action against these fraud doctors.

    My dad was diagnosed with a small clot in the head and a doctor called Madhusudan a nuero surgeon in our town from a reputed hospital informed us that we should go for a surgery and his assistant told that all they would do is drill a small burrow and take it out , my dad was fit and fine only he had blurred speech . The doctor told us it would take 3 days and he will discharge my dad and gave us 90 percent success , but after 15 days in ICU he asked us to take to a higher medical centre eventually my dad lost his life
    Please advise me how to file a case against the doctor he has mislead us and killed my father

    Can a patient party be subjected to civil defamation case by the doctor if the complaints made are considered by the medical council not valid and the doctor is exonerated. There is no mal intention involved in the complaints.

      My dad was diagnosed with a small clot in head and a doctor called Madhusudan from a reputed hospital informed us to go for a procedure , he informed us that a small hole will be drilled and the clot will be removed he assured us there is nothing to worry and gave us 90 percent success rate after 15 days in ICU all he told us he has no idea and informed us to take to higer medical centre eventually my dad lost his life

      Please guide me to file a case
