To solve all these problems and making the task easy for the people these days there are PACKERS AND MOVER companies which exist in the market.

WHO ARE PACKERS AND MOVERS?

  • Packers and movers are those people who will help you to pack your belongings and them move those belongings to the place where you want in the most safest and convenient way.
  • One of the most striking features of the packers and movers is that they accept the full responsibility of the belongings and if any damage is caused to the belongings it is them who need to recover those damages.
  • When these types of services started in India there were two different sets of people who used to deal with two different set of tasks that is one used to pack all your materials in proper kinds of packing materials and then the other was responsible for the transportation of those goods. However, with the time both of these services are provided by the same single service provider

There are generally two types of packers and movers which exist in the market. Firstly, the public or local packers and movers which help the local public to shift their belongings from one place to another when they shift their houses and secondly the industrial packers and movers who help the industries to shift their goods for various purposes from one place to another. Generally, a person should prefer using a professional company which provides these services as they provide better guarantee and insurance of your goods.

Misappropriation of goods during transportation

Several cases of theft and robbery have been reported by the people where the drivers of the trucks have misappropriated their belonging while shifting their materials and have fled away. There are certain deficiencies which can be observed on the part of the packing and moving services and before complaining about the company you need to recognize the deficiency so that you can claim damages in a better way:

Late Delivery of Goods

While hiring a packers and movers service you will always need to sign a contract in which the date of delivery of goods will be stipulated and if a company fails to deliver your goods on that particular date you have a complete right to sue or take action against the company. This is not a big deal if the local belongings of a person needs to be shifted but in the case of industrial transfer it is a serious issue as a minor delay of two to three days can lead to huge loss for the industries.

Lost or damaged goods

This is one of the most important areas of concern during the transportation of goods and needs to be dealt with utmost concern. People often report that the goods were broken after the delivery or goods are often misplaced in certain cases. This is a serious mistake on the part of the company as they take the responsibility of appropriating your goods properly and safely.

Extra delivery charges

It is often observed that the packers and movers company charge extra delivery charges when they deliver the goods even when it is nowhere mentioned in the contract signed by you and in some cases they already charge you for the services beforehand only. It is the responsibility of the customers to be aware of the terms and conditions which they have signed in the contract and not to get befooled by the companies.

Legal actions against Packer and Movers company if they fail to deliver your goods safely

If you have hired a packers and movers services and suffer from any such deficiency in the services provided by them then you can avail the following legal remedies:

  1. Before going for any legal proceedings or any legal suit the first step you should take to resolve your issue is to contact the company directly and ask them to solve their grievances. If they fail to do so or they do not pay attention to your queries then you should go for a legal procedure. One most important thing which you should keep in mind while communicating with the company is that always use a method of communication which can be used as an evidence in the court of law for further legal proceedings. You should try to contact them with the help of emails or written letters rather than telephonic conversations.

Filing of Consumer Complaint against packers and movers company

  • If the company does not pay attention to your grievances or does not pay you the damages then you can file a CONSUMER COMPLAINT under section 12 of the Consumer Protection Act 1986 in the consumer forum or can file a consumer complaint online.
  • The consumer forums were introduced in India keeping in mind that the consumer’s rights should be protected and they should not be discriminated.
  • It is clearly stated by the consumer court that the movers and packers company are a part of services under this act and one can approach the consumer courts to get the remedies.
  • Filing a consumer complaint is beneficial over legal proceedings as it includes less expenditure, as well as the time taken, is also less. One more advantage of filing a consumer complaint is that you need not hire an advocate to fight for your case and you can present your case on your own before the consumer forum.
  • There are consumer cells as well where cases can be solved with the help of mediation also which is very beneficial these days.
  • If you are not satisfied by the way consumer court works or are not satisfied with the decision of the court you can file a separate civil suit in the court of law. You can hire an advocate and send a legal notice to the company and then the proceedings will be held in the court. You can also file a consumer complaint and a case in the court of law at the same time. There is no bar to it.

Can a FIR be filed against Packers and Movers company alleging fraudulent intention

  • You can also file an FIR against the Packers and Movers Company at your nearest police station but generally the police does not file FIR in the cases related to unofficial enquiry but when a prime facie deceit is proved the police will lodge a FIR under section 421 of the Indian penal code under FRAUD. You can also file a consumer case and a FIR simultaneously.
  • If you have taken the insurance of the goods you can immediately claim for insurance from the insurance companies so that you can recover the damages easily. Claiming insurance is no bar to lodging FIR. You can lodge FIR for the insured goods as well.

These are few remedies which can be sought by the people if they are cheated by the movers and packers company or there is a deficiency in services on behalf of them.

Precautions

As it is rightly said that precaution is always better than care there are few precautions which can be taken before hiring a packers and movers company:

  • Always hire a registered company: You should always avail services from a registered company and which has a license to do so. Always check the credibility of the company. You can also check the reviews about the company on various online platforms.
  • Read the terms and conditions of the contract carefully The companies often try to mislead the customers by manipulating the contract which they sign and then discriminate the customers on the basis of it. You should always read all the terms and conditions of the contract and then sign the agreement.

Hii…I recently transported my good through APML ..I had paid 90% advance and somehow missed the 10 % by mistake… however when I received my items, I realises that my bike seat,almirah, photo frame and fridge and few furnitures had got damaged and I am still holding the 10 % payment with me…when I raised the issue with the claim department they offered me 2000 rupees as claim and said that I am not eligible for any more as I have not availed transit insurance.however I have had a loss for more tha 10000 rupees and do not wish to return the money.can I want advice to whether I can go ahead with my decision

  4. On 29th Dec2020 I booked house hold goods form Delhi west Patel Nagar to Bengaluru through Data packers and movers, Gurgaon and office is also in Dwaraka Some of the goods were damaged. When I contacted insurance company they refused to pay for the damage. They told that these goods are not covered under this policy. When I asked the data company to pay the damages.Now they are telling the damage items are properly. Mandal, Pushpa truecaller and one sharma these people just lie before the booking is done, that all the items are covered and Wii get damage charges . These companies are fraud and these people should be arrested for cheating and fraud. Government should keep eye on these fraud companies and banned.

    I have booked “LEO INTERNATIONAL” packers and mover to shift my stuff from BANGALORE to GURGAON.
    He told me final rate 13000 to shift. Now during lockdown he called me and told sir you want me to deliver your stuff or can i keep in my warehouse. I told now lockdown in my area. you can keep my stuff to your warehouse. earlier he told me he will charge 50/- /day. now hetold me 300 lagega.
    i was agreed because i dnt had option that time.
    Today i called him to delivered my stuff to my location.
    Now he is giving me bill of 50000 .to delivered my stuff. and he is saying first transfer all money then next day you will get your stuff.

    Please help me what to do…

  9. Well we share the similar fate like many posted above.
    DAS & GHOSH ROADWAYS & PACKERS & MOVERS operated by one Mr. Santosh Das (8013093740) operating from Khardah, B. T.Raod, Kolkata 700117
    They spoke really nicely telling us that they would assist in packing and moving our household goods from Kolkata to Pune. Once we loaded the goods, he started asking for full payment and said that this is how they operate. Initially they told that insurance is also covered under the package but when I asked for Insurance papers he said that you would have to pay extra now.
    Later he started asking to pay extra 4K bucks saying that you said dining table and not set which was totally wrong and said otherwise your goods would be lying in a warehouse in Kolkata. So we paid the full payment and extra bucks too.
    Once the goods reached Pune, he calls me up and says that collect it from Pune warehouse. I am totally speechless and aghast. Not sure what to do.

I am very disappointed with Altess relocation service (Packers & Movers), I have sent my house hold things through Altess on 9th Oct’19, and the owner of the company Jitendra had promised to deliver my house hold goods within five days, and it’s been now 26 days and still I have not received my house hold thing after many follow-ups.
    I have sent my house hold things 2 different places one for Lucknow and another one for Bangalore at same time, and which I have received in Lucknow that goods condition was very bad and also I have received that after many follow-ups.

    However after receiving my goods in Lucknow I am worried about my fragile and costly items which I had sent for Bangalore location which still I have not received and still doing follow-up but no proper response yet, and company owner and team had stopped receiving my calls and disconnecting my calls too. What does it mean???

    I am in Bangalore now without my household things since two weeks, I travelled here for some purpose which I could not do as I don’t have my things here, Altess are unorganized for that I am suffering here, with many loses.. who will be responsible for my everyday loses ???

    As courtesy from their side I haven’t got any mails or call to update for this delay moreover they are asking me to pay 100% payment before the delivery on which basis I can pay ?? even I had paid already 80%, also they are asking me to pay additional money for same and the way they are behaving its very inappropriate.

    Very bad service if I would be knowing this earlier would have sold my house hold items instead of wasting my energy and mental peace,

    I want someone has to take serious action for these types fake companies, how these companies get authorities to serve even they are not organized well to do these critical and responsible work 

  11. Detailed and well written post. Often people end up hiring movers without paying attention to check the authenticity of a moving company. When you hire a moving company after checking all the documents and understanding the terms of service etc, you tend to decrease the chances of scams and frauds by moving company.

  12. I hired a Packers and Movers service from M/s Dhanshree Packers & Movers from Surat for Raipur Chhattisgarh. They promised delivery within 36-48 hours. I received delivery after 9 days that too with 80% goods fully or partially damaged. Now packers ન movers not ready to help, rather putting all blame on Truck driver n transport guy. TV unit, Almira, Kitchen appliances all broken. Please help.

  14. Aman Cargo Packers of Mumbai Airoli kept my households for a year as I was moved out of India for an assignment. I already paid sux months advance payment before leaving. After coming back they charge me more as they told rent should increase after six months. I did argue much and settled the amount. Then I asked my stuff to move to Bangalore. They asked me to pay the transport charges first and next day they start shipping. I paid the whole amount. But since next day morning they stopped taking my calls and cut the calls, even blocked my number. They totally stop communication. And later I found the office shop also they closed it. I got cheated by them roughly. The packer guy name was Vikas. And the number was +919321012744 ,+919821012744, +919820305020… They will pick my call if I call for from a different number. But after realising they will immediately disconnect the call and block that number too. This is really disgusting. Can somebody help me please.

  15. Agarsen Cargo Packers Mover located at 13/B, Banjara Hills, Road no. 11, Gauri Shanker colony, Hyderabad, is a fraud co..CHEATERS!! FRAUDS !! UNFAIR TRADE PRACTICE !! WORST PROFESSIONALISM !! NON-COMMITTED (5 STARS). Without issuing a valid GST bill, Insurance policy, by issuing a forged invoice they are demanding clear ransome in return of equipments. Simply, they are uncommitted and extract money by blackmailing this is their style of working. They fill their pockets by collecting GST, Service Tax and insurance charges, but at the end of the day, does it go to the Govt. treasury? or rather they fill their pockets taking such plea. The company just have such means of doing business. They quoted me 23,144 RS for my shipment from Hyderabad to Delhi for my household furniture n Scooty with the payment as 20% in Hyd n remaining 80% upon delivery in Delhi. I trusted them and got my equipment loaded n Swiped my credit card for 20% using the swipe machine they bought. Within no time the pickup guy named Sandeep/Randeep, turned around & cancelled the transaction for 20% & Swiped for 100% (23,144 RS). He knows my credit card pin by Shoulder surfing on first transaction. I didn’t mind coz he said he did it specifically for figure 23,144 rs. & did that by mistake. I was convinced that I paid 100% for their Services. I arrived in Delhi and they Started asking more money (15K). I objected & in response they started abusing, which in turn led me to reply them the same way. Finally Manager Sunil called me because of complaint filed in Just dial (that’s how they called me) and said he will send it at no extra cost after & denied 4 dayslater. I have filed a case against them n will ensure the owner is sued.

    I moved my items form GatiExpress Packer and movers from Hyderabad to Bangalore.

    They broke my TV and I have also paid the insurance amount and now when I call the owner he says insurance guys are not providing the amount and he will give some money to me to get it fixed on my own.

    I asked him to transfer the money, the guy is not attend my call nor he is responding to messages.

    I am planning to file a complaint against him in Police station, can you guys also suggest what else I can do with this horrible people.

    Guys never go with GatiExpress Packer and Movers.

  17. We moved from Mumbai to Bangalore and shifted our belongings through one Parminder Gupta and hid bhat is agent. All my goods damaged. Washing machine which was only a year old was fully damaged and the worst part is our cycle with 15000 which was loaded in Mumbai on Apr 25th along with all goods is yet to come. All other goods damaged and delivered on 3rd May but cycle is Missing. When asked each day he says it will reach next day and by mistake gone to odisha then Coimbatore etc.
    Don’t know what to do

    • @joy I also lost my cycle during transit from Mumbai to Bangalore by Agarwal Packers and movers and Still got no reply.As per me cycle are easily stolen by there team during transit and there is no way we can stop it.

      I don’t know in a year how many such occurrence of cycle stealing happen when someone use this type of movers.

    check whether the company ISO certified or not
    check the customer’s feedback
    Compare with other packers and mover’s companies whether it is a reliable service or not
    check all the competitive prices and analyse which one is the most effective cost

I sent household goods of my son Mr. Saurabh Agarwal from New Delhi to Bangalore through M/s Agarwal Packers and Movers (a unit of M/s DRS Logistics Pvt Ltd) on 18.03.2019 vide their GC No. 4542637. While tracking consignment, they informed that the vehicle broke down on way and goods had to be trans-shipped. However, my son has not received his goods till now. Please help

  26. BEWARE!!! of this Fraud Person TAMAL MUKHERJEE he will act like head person of MAXWELL MOVERS AND PACKERS. It’s a fake company as the original one is Maxwell Relocations. He is using there name and running this fake site and address phone number all details are fake. He will make all the false promise of transferring your valuables on time that all will never happen.
    He will act like a very sophisticated person,
    First he will ask you to tranfer the money he will take some decent amount so that u can easily transfer him then he will take the Luggage and will never transfer the amount nor the valuables.
    Also all the time his mobile will be switched off you will never be able to contact him even if he picks up the call again he will make some stupid stories and will switch it off again.
    Before choosing Maxwell Mover and Packers be ready to loose your money and valuables as well.

    This is to share with you that I have booked Agarwal cargo movers group, dwarka/ gurgaon on 26.12.2018
    They collected all are household belongings worth Rs 200000/- and left home at 1pm on that day from Delhi to Kolkata.
    We kept contacting them on their helpline no 8930896001/7419166001 paid the amount too. It’s almost 25 days now we have not received our things.
    My wife is pregnant, and i cannot leave her at home alone and run after them in Delhi. We are helpless please help us .?
